Terms of service

CX8 is operated by Connect Exchange (ABN 12 620 184 867). "We" and "us" mean Connect Exchange. "You" means the person using CX8, and where you are using it for a business, that business as well.

By creating an account you agree to these terms. If you do not agree, do not create one.

What CX8 is

CX8 is a directory that connects businesses with work. You can create an account, set up a workspace, and publish information about your business so that people looking for what you do can find you.

We are a place where that introduction happens. We are not a party to whatever you agree with somebody you meet here, we do not guarantee that you will find work or find anybody, and we do not vet the people you deal with beyond what is described on the service.

Your account

You need an account to use most of CX8. When you create one:

You must be at least 18, and if you are acting for a business you must be authorised to accept these terms for it.

What you may not do

Do not use CX8 to:

We may remove content and suspend accounts that do these things.

What you publish

You keep ownership of what you put on CX8. Your listing, your messages, your files — they remain yours.

So that we can run the service, you give us permission to store, copy, adapt where the format requires it, and display what you publish, on CX8 and in the ordinary promotion of it. That permission lasts as long as the content is on the service, plus the time it takes for backups to age out.

You promise that you have the right to publish what you publish, and that doing so breaks no law and no agreement you are under.

We may remove content without notice where we believe it breaks these terms or exposes us or somebody else to risk. Where we can, we will tell you why.

What we publish

Everything on CX8 that is ours — the software, the design, the words we wrote — stays ours. These terms do not give you a licence to it beyond using the service as intended.

Availability

We do not promise any level of availability at this stage, and we do not offer credits for downtime. We will try to keep CX8 running and to give notice before planned interruptions, but early-stage software goes down.

We may change, suspend or withdraw parts of the service. Where a change removes something you were relying on, we will give you reasonable notice unless the change is needed urgently for security or to comply with the law.

Fees

Where CX8 is free, we may begin charging for it. Where it is paid, we may change the price. Either way, we will tell you at least 30 days in advance, and a change will not apply to a period you have already paid for. If you do not want to continue, you can close your account before the change takes effect.

Prices shown on the site are in Australian dollars and include GST unless stated otherwise. The price you are charged is the one in your billing settings; a price on a marketing page is a description, not an offer.

Ending it

You can close your account at any time from your settings.

We may suspend or close your account if you break these terms, if we are required to, or if we stop offering the service. Except where the law requires otherwise or the reason is urgent, we will give you notice and a chance to get your content out.

When an account is closed, we delete or de-identify what we hold about you on the timetable in our privacy policy.

Our liability

Some rights cannot be signed away, and we are not trying to. Under the Australian Consumer Law you have guarantees — among them that a service will be supplied with due care and skill, and will be fit for a purpose you told us about. No agreement can exclude, restrict or modify those guarantees, and nothing in these terms attempts to.

Where the law does allow us to limit what we owe you for failing one of those guarantees, we limit it to supplying the service again, or paying the cost of having it supplied again.

For everything else, and as far as the law permits:

We do not exclude liability for fraud, or for death or personal injury caused by our negligence. Those cannot be excluded either.

Indemnity

If somebody brings a claim against us because of what you published on CX8 or because you broke these terms, you agree to cover our reasonable costs of dealing with it. We will tell you promptly about any such claim and will not settle it without asking you first.

Changes to these terms

We will update these terms as CX8 develops. When we do, we publish the new version here with the date it takes effect, and the earlier versions stay readable at their own addresses.

For a change that materially reduces your rights, we will give you at least 30 days notice by email before it takes effect. Continuing to use CX8 after that date means you accept the new version. If you do not, close your account.

Law

These terms are governed by the law of South Australia, and you and we submit to the courts of that state and the courts able to hear appeals from them.
